This Creator Terms & Marketplace Agreement (the "Agreement") supplements the Terms of Service and governs the relationship between Fairmont S.r.l. and every Creator who publishes or monetises content on La Stanza Segreta. Acceptance of the Agreement is mandatory to complete the Creator onboarding and is recorded with date and time, IP address and the version of the contract accepted.

In the event of a conflict between this Agreement and the Terms of Service, this Agreement prevails with regard to the specific obligations of Creators.

Every Creator represents and warrants that they:

• possess the written consent of all identifiable persons appearing in their content;
• have obtained from every depicted person express authorisation for: the recording, the publication, the distribution and the possible download of the content;
• will retain such documentation for the entire duration of publication and for the subsequent period required by law;
• will provide it immediately to the platform upon simple request.

Uploading content without documented consent constitutes a serious breach of this Agreement and triggers the measures described in the "Violations and enforcement" section.

The Creator warrants that:

• all persons appearing in the content are at least 18 years old;
• the identity and age of all depicted persons have been verified before the content was produced;
• the related documentation (valid identity document and signed release) is available for inspection by the platform, the card schemes (Visa, Mastercard), the payment processors and the competent authorities.

It is expressly and absolutely prohibited to publish, distribute or monetise:

• content involving minors in any form;
• revenge porn and intimate images shared without consent;
• non-consensual content of any kind;
• content produced through coercion;
• content involving the exploitation of persons;
• content connected to human trafficking;
• unlawful violence;
• illegal material of any kind;
• content in violation of copyright or other intellectual property rights;
• impersonation of third parties;
• unauthorised deepfakes or deepfakes referable to identifiable persons without their consent.

The platform applies a zero tolerance policy: violations lead to the immediate removal of the content, suspension or permanent termination of the account and reporting to the competent authorities where required by law.

The Creator is required to:

• retain all documentation relating to consent and to the age and identity verification of depicted persons (signed releases and copies of identity documents);
• keep it up to date and accessible for the entire duration of the publication of the content;
• provide it upon request of the platform, within the deadline indicated in the request itself.

Failure to produce the requested documentation results in the immediate removal of the affected content and may result in the suspension or permanent termination of the account.

For the purposes of moderation, audit, dispute handling and compliance with the requirements of the card schemes (Visa, Mastercard) and payment processors, the platform retains uploaded content for 60 days, including after its removal or deletion, in a protected, limited-access environment.

After this period, the content is permanently deleted, unless different legal obligations apply or the competent authorities request otherwise.

In the event of a breach of this Agreement, the platform may apply, proportionately to the severity:

• immediate removal or disabling of the content;
• a request for additional documentation from the Creator;
• temporary suspension of the account and of monetisation;
• permanent termination of the account and of the contractual relationship;
• withholding of amounts not yet paid out, within the limits allowed by law, in cases of fraud or serious violations;
• reporting to the competent authorities.

Acceptance of this Agreement takes place during the Creator onboarding through three mandatory and separate declarations concerning: (1) the adult age of all depicted persons; (2) the possession of written consent and identity verification documents; (3) the awareness of the consequences of failing to produce the documentation upon request.

Every acceptance is recorded with date and time, IP address and contract version. In the event of substantial updates to the Agreement, Creators may be required to accept it again.
